Florida waterfront real estate reflects the diverse way that settlers in Florida have embraced a waterfront lifestyle. Because Florida waterfront property is a scarce commodity, timing is everything for Buyers. Waterfront home Buyers are surprised that many homes are under contract in just a few days. As Buyer Brokers we represent the Buyers interest exclusively. Florida Law mandates that all real estate licensees (agents/brokers) are "Transaction Brokers", unless they specifically agree otherwise. Transaction brokers have no Agent or Agency (fiduciary) relationship with customers. They are simply there to "facilitate a transaction" and close the sale. As a dedicated buyers only brokerage, we put our fiduciary commitment to represent and protect our buyers interest in writing. We NEVER act as Transaction Brokers or have contractual obligations with sellers that could create a conflect of interest with our buyer clients.
SMART Home Buying
Being a Smart home buyer doesn't have anything to do with IQ. It does have a lot to do with common sense. There are a lot of opinions out there on what NOT to do as well as opinions of what to do. A smart home buyer uses their common sense to determine what best serves their needs.
Years ago, back in the 1950s, companies that were looking to purchase property decided what they needed was a Real Estate professional that had the company's and only the company's best interest as their goal. So companies began hiring their own real estate professionals. They would put this individual on the companies payroll with the single task of finding the properties that met the company's needs, researching them thoroughly and negotiating the very best purchase. The thinking was that these real estate buyer specialists would save the company more then enough money to pay their salary. Companies wanted an experienced agent that had enough sales experience to understand the seller's perspective but not the driving influence of a "sales team" organization. This person would not only be the companies employee but, would also have the legal duties and responsibilities as the compaines AGENT.
Today real estate brokerages are sales organizations. They contract with property owners to sell their property. Their loyalty is to the seller as it should be and their primary objective is selling the property for the highest price possible.
So, common sense tells us that if we are buying we should look for one of these buyer specialists to work for us. Today, these specialists are called "Exclusive Buyer Agent" or "Buyer Brokerages". They do NOT work in your typical "sales orientated" Brokerage, they work in Buyer Only Brokerages. They never have listings they must sell or the contractual sales obligations that Traditional Brokerages have with listings. Their loyalty and commitment is to the Buyers interest. Perhaps the best thing about getting your own buyer agent is that there is no payroll and typically no cost at all to Buyers.

According to the National Association of Realtors® (NAR) publication 2000 'Agency - Choices, Challenges, and Opportunities', Exclusive Buyer Agency is: "The practice of representing only buyers and never sellers in a transaction. The company (Brokerage) never lists a seller's property and thus never has a seller as a client." The publication goes on to say that Exclusive Buyer Agency, " Promotes a more natural relationship for agents working with buyers". Why ? ".... any brokerage listing properties for sale is used to representing Sellers and has a legal commitment (responsibility) to protect the Sellers interest and must get the highest price possible for the Seller.
The National Association of Realtors (NAR) has OPPOSED "Transaction Broker" Real Estate since 1993 as parties must relinquish their RIGHT to the protections afforded by FULL REPRESENTATION of an AGENT / AGENCY relationship with their Realtor.
